While we try to ensure that all prices on our website are accurate, errors may occasionally occur. Once we are aware of an error, we will correct it. Should you discover an error in your order, please get in touch as soon as possible so we can correct it.

You agree that email can be used as a long-distance means of communication.
This confirmatory email will contain all relevant statutory information concerning your contract.
You must check that the details on this confirmatory email are correct as soon as possible, and you should print out and keep a copy for your records.

To ensure that your credit, debit or charge card is not being used without your consent, we will validate the name, address and other personal information supplied by you during the order process against appropriate third-party databases, including registered credit reference agencies and fraud prevention agencies, who may keep a record of that information. By accepting these terms and conditions, you consent to such checks being made.

You undertake that all details you provide to Fernhill Wholesale for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own, and that there are sufficient funds to cover the cost of the goods or services ordered.

You must choose a username and password upon completion of registration. You are responsible for all actions taken under that username and password, and shall only use the site under your own login credentials. You must make every effort to keep your password safe and must not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone else to use your username or password.

If there are any changes to the details supplied by you, it is your responsibility to inform Fernhill Wholesale as soon as possible.

The products sold on the site are provided for private domestic and consumer use only. Accordingly, Fernhill Wholesale does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss or damage to property, and/or loss from claims of third parties arising out of the use of the site or for any products or services purchased from Fernhill Wholesale.

Credit and debit cards are debited on the day of shipping by Fernhill Wholesale. All prices exclude VAT (where applicable), unless otherwise stated. VAT will be added at the final checkout stage.

The period stated for delivery of your order is approximate. Goods will be sent to the address you provide in your order and confirmed in the Order Confirmation. We do not operate a back-order system, so any item not received will be cancelled and must be re-ordered.

We shall have no liability to you for any delay in delivery or other matters to the extent that such delay is due to events beyond our reasonable control, including but not limited to: acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions, or other similar events.

We shall have no liability (including for negligence) for the acts or omissions of telecommunications service providers, or for failures or faults in their networks and equipment.

No waiver by us of any breach of these terms shall be considered a waiver of any subsequent breach of the same or any other provision.

You may not permit or create unauthorised framing of, or deep linking to, the site, or create derivative works thereof from any other website under your management or control.

In these terms, “Intellectual Property Rights” means patents, database rights, copyright, design rights (registered or unregistered), trade marks (registered or unregistered), and similar rights, together with the right to apply for protection of any such rights. All intellectual property rights in the site are owned absolutely by Fernhill Wholesale.

It is a criminal offence to use a false name or known invalid credit card to order. Anyone caught wilfully entering a fraudulent or fictitious order will be prosecuted to the fullest extent of the law. Fernhill Wholesale tracks the electronic ‘fingerprints’ of every order placed on www.fernhillwholesale.co.uk and www.fernhillwholesale.com to enable us and law enforcement authorities to trace users engaging in criminal activity.

We reserve the right to terminate this agreement and suspend or terminate your access to the site immediately and without notice if:

• You fail to make any payment to us when due, whether by card or 30-day credit account
• You breach the terms of this agreement (repeatedly or otherwise)
• You fail, when requested, to provide us with sufficient information within a reasonable time to determine the accuracy and validity of any information supplied or your identity
• We suspect you have engaged or are about to engage in fraudulent or illegal activity on the site

Fernhill Wholesale may amend these terms from time to time.

These terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or written, and contain the entire agreement between Fernhill Wholesale and you regarding your purchase. Fernhill Wholesale advises that you print and retain a copy of these terms and conditions once your order has been accepted. We will store a copy of the contract entered into by you with Fernhill Wholesale. You are advised to read (and are responsible for reading) all information on this website in full.

If any provision of these terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining provisions and the remainder of the affected provision shall remain unaffected.

Fernhill Wholesale reserves the right, in certain circumstances, to limit the number of outlets we supply in one area for specific product ranges, where outlets are in close proximity to each other.
